2024 Update on Legal Advertising, Ethics & Compliance for Law Firms

Tuesday, September 24 | noon - 1 p.m. ET

The KBA will provide attorneys and legal marketing professionals an update for the 2024 rules and procedures for print and digital advertising and also discuss ethics and compliance. Attorneys will be able to receive 1 KY CLE Ethics Credit which is pending.

Lunch will be provided please indicate if you have an allergy restrictions.

Training Objectives

  • Overview on submitting advertisements for an advisory opinion
    • SCR 3.130(7.01) – Ad exceptions
      • Business card
      • Public Service Announcement – limit info to lawyer/law firm by name, address, and telephone number
      • Office sign
    • SCR 3.130(7.03) – Request signed by an attorney; 3 copies of advertisement; cost
  • Common issues; Specific disclaimers and when to use them (RPC 7.10)
    • SCR 3.130(4.5) – Direct mail and email blasts; Social media; Electronic communications; Geocaching
    • SCR 3.130(7.20)(3) & AAC Regulation 1C – Name of attorney/firm; street address; 800# or area code where office is not located
    • SCR 3.130(7.20)(5) – Services may be performed by others; attorney not licensed in KY; and advertising to refer to another lawyer or law firm
    • SCR 3.130(7.15) & AAC Regulation 14 – Stated fee in advertisement; contingency fee stated in advertisement; if a percentage is stated, how is it calculated; and court costs and case expenses
  • Difference between AAC and the Ethics Hotline – when to check with each
    • AAC can only address reviewing specific advertisements
    • Attorney needs to contact the Ethics Hotline if have questions involving whether specific actions/statements violate the ethics rules (SCR 3.530)

Mary Ellen Hardy
Attorneys' Advertising Commission

Mary Ellen Hardy is the Attorneys’ Advertising Commission Paralegal. Ms. Hardy received her B.A. in Paralegal Science from Eastern Kentucky University in 1986. She first worked for a law firm in London, Kentucky before going to work in the Corporate Law Department at Ashland Inc., where she worked for 20+ years. She began working at the Kentucky Bar Association in May 2009 as the Attorneys’ Advertising Commission Paralegal. In addition, she has been the Bar Counsel Paralegal for the Unauthorized Practice of Law Committee since 2016, coordinates the Ethics and Professionalism Enhancement Program (EPEP) and the Trust Account Management Program (TAMP) training, as well as assisting with Bar Complaint Intake.


Ashley Chilton

Deputy Bar Counsel

Ashley Chilton is Deputy Bar Counsel in the Office of Bar Counsel with the Kentucky Bar Association. In this capacity, she investigates and when appropriate, prosecutes violations of the Kentucky Supreme Court’s Rules of Professional Conduct. Ashley is also the Bar Counsel liaison to the KBA’s Unauthorized Practice Committee and the Attorneys’ Advertising Commission. Ashley served on the NOBC’s Standing Committee on the Future of Lawyer Regulation since 2020, and in September 2023, she was appointed chairperson. She has also served on the American Bar Association’s Standing Committee on Public Protection in the Provision of Legal Services. Before joining the Office of Bar Counsel in 2014, Ashley was an Assistant Fayette County Attorney in Lexington. Ashley is a graduate of the University of Kentucky and Northern Kentucky University, Chase College of Law.
